Saunum Leil App Terms of Use

1. Introduction

These Terms of Use (“Agreement”) is legally binding between You and Saunum Saunas OÜ (“Company”, “we”, “us”, or “our”).

This Agreement sets forth the general terms of Your use of the Saunum Leil mobile app (“Application”) and any of its related products and services (“Services”).

By making any access and use of Application and Services, You acknowledge that you have read, understood and agree with the terms and conditions expressed in this Agreement. You acknowledge that this Agreement is a contract between You and the Saunum. If you do not agree with the terms of this Agreement, you may not access and use the Application and Services.

2. Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Agreement:

Account means a unique account created for You to access our Service or parts of our Service.

Application means the software program provided by the Saunum downloaded by You on any electronic device, named Saunum Leil

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Saunum Saunas OÜ, Läike tee 2, 75312 Peetri.

Service refers to the Application and any of its related products and services.

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3. Accounts and responsibility

By creating an Account in the Application, You acknowledge that You are fully responsible for maintaining the security of your Account and You are responsible for all activities and any actions taken in connection with it.

You acknowledge that You have read all the mandatory warnings and manuals carefully before using the Service. Failure to follow the instructions could result in personal injury, death, fire, and/or property damage, and the related device's warranty may be voided. In any case the Company’s liability is limited to direct patrimonial damages. In addition, the Company is not liable for loss of profit and the liability shall not exceed the amount You have paid to the Company. The Service is meant for controlling the sauna heater and the functions intended for the control unit. You are prohibited from using the Service for any other or unlawful purpose; to ask others to perform or participate in any unlawful acts; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Application and Services. We reserve the right to terminate the use of the Application and Service for violating any of the prohibited uses.

4. Intellectual property rights

Application is licensed for Your usage for unspecified term, not sold, and the Company retains all rights to the Application. License fee is included in the amount you have paid to the Company and You have no obligation to pay additional license fee. All trademarks, graphics and logos used to visualize Company Application and Service, are trademarks or registered trademarks of the Company. Other trademarks, graphics and logos used in connection with Application and Service may be the trademarks of other third parties. Your use of the Application and Service grants you no right or license to reproduce or otherwise use any of the Company or third-party software, trademarks, graphics and logos.

5. Changes to this Agreement, applicable law and disputes

We reserve the right at Our sole discretion to update Our Agreement relating to the Application and Services at any time. These updates will be effective immediately upon We post them on Application. Effective "Last updated" date is set out at the top of this Terms of Use. Continued use of the Application and Services after any changes shall constitute Your consent to changes.

This Agreement is subject to the laws of the Republic of Estonia and all disputes are to be solved by negotiations. In case no settlement is reached, Harju County Court shall solve the dispute under applicable Estonian laws of procedure.
